Judge Jamie Commons ruled on Friday that the government established by clear and concrete evidence that the Khalil was removable. Khalil’s lawyers said that they would appeal against the decision and hence Khalil will not be taken out of the country immediately.
In his argument to send Khalil out of the country, the state secretary Marco Rubio filed a two-page memorandum to the court and said that Khalil’s presence weakened the US policy to deal with Antimitism. The verdict in Khalil’s case was closely followed as many other international students canceled their visas and then arrested by snow. Khalil, however, is a green card holder and an American citizen. His arrest and the threat of exile showed how the Trump administration would go even after the green card holders.

Mahmud Khalil was born at a refugee camp in Syria. His family fled to Lebanon in 2012. He came to America in 2022 and an American citizen Dr. Married to Noor Abdullah. Although he came to America on a student visa, he became a legal permanent resident as he became the life partner of an American citizen. He was involved with the apartheid development of the University of Columbia, which is an alliance, advocating partition from Israel and a ceasefire in Gaza.
The Trump administration said that Khalil was not only protesting pro -Palestine, but also spreading Hamas’s agenda. He said that the Hamas distributed flyers such as Hamas Propaganda, and supported Hamas’s works on October 7, 2023, including the attack on Israel, the administration said.
However, Khalil and his legal team denied any direct support for Hamas, claiming that their activism focuses on Palestinian rights and not Hamas. His lawyers argued that his Hamas link allegations are based on his independent speech, such as social media posts or wrong details of protest activities, and no concrete evidence, such as physical support or coordination with Hamas, has been publicly presented by the government.
