Bhopal/Jabalpur: Madhya Pradesh HC has ordered a cedar under the POCSO Act against a person who filed a captive corpus petition to find his “missing” minor daughter. When she was produced in court, however, she refused to return to her father, accusing her of “sexual advance”, and said that she lives with her female friend with whom she ran away from home.A bench of Justice Atul Shredaran and Justice Anuradha Shukla recently sent 17 -year -old Nari Niketan to Nari Niketan until not being an adult. However, the court said that the girl may have accused her father out of Vendetta, so the police should not arrest her until she is necessary.The girl went missing in April. Her father filed a captive corpus petition when the police failed to detect it despite a cedar, in which he named a man who could “host”. Following an HC directive, the police tracked him and produced him in court on 21 April 2025.In his statement before the judges, he said that his father had married a person for Rs 1 lakh. She said that she does not want to be with her father because she does not feel safe. She alleged that when she was sleeping, she used to touch her improperly. He was always intoxicated and abused him, he said, ran away with a friend and he only wanted to be with him.The court said in the April 25 order that the girl had made serious allegations against her father, so the police should register a case. The bench said that it should be arrested only when the police are sure that after investigating the allegations of the girl, catch water. By the time she turned 18, the girl will remain in ‘Nari Niketan’. After that, she will have the freedom to decide what she wants to do.
