Madras HC has made provision to appoint Tamil Nadu Government as Vice Chancellor

New Delhi: The Madras High Court on Wednesday gave an interim migration to the provision of empowering the Tamil Nadu government to appoint the Vice Chancellor in the state-run universities despite strong objections from MK Stalin-Government.The provision that has been there was originally part of the bills that were accepted by the Supreme Court in the Tamil Nadu government vs. Governor case.The petitioner in the case is a lawyer who also holds a post within the BJP.A division bench including Justice GR Swaminathan and V Lakshmi Narayanan issued a stay. The state government opposed the matter and said that it was taken in a hurry.It was filed earlier this month when the petitioner argued that the amendments struggled with the objectives of the University Grants Commission (UGC) and the regulatory structure. “State universities are recognized as universities within Section 2 (F) of the UGC Act and are also recognized by the Commission under the applied rules. Therefore, any amendments made by the state affecting such universities, especially for the appointment of VC, violate the constitutional distribution of the powers in areas already covered by regulation,” said the petitioner.
