New Delhi: The right to digital access is an internal part of the ruling Fundamental right to life and freedomThe Supreme Court on Wednesday said that it is a constitutional imperative for the Center and its officials, which is to bridge the digital division faced by large sections of rural population, senior citizens, economically weaker communities, linguistic minorities and big sections of different individuals.
The SC passed a group of directions to modify the current KYC process for visually and hearing-spoiled users, and to develop alternative forms- to ensure access to all including Braille and Voice-Services Services.
Digital changes should be inclusive, justified: SC
At this point, we can also see that in the contemporary era, where the essential services, governance, education, healthcare and access to economic opportunities are rapid mediation through digital platforms, the right to life under Article 21 of the Constitution should be re -evacuated in the light of these technical realities. Digital division – is characterized by uneven access to digital infrastructure, skills and materials – not only disabled individuals, but maintaining systemic exclusion with large sections of rural population, senior citizens, economically weaker communities and linguistic minorities. The principle of basic equality demands that digital changes are both inclusive and justified, ”the Supreme Court said.
Justice R. Mahadevan, who included the judgment for the bench, which included Justice JB Pardiwala, on the petitions filed by the victims of the two acid attacks, who suffer from facial disintegration and 100% blindness, said that true inclusion requires technical advice to meet the diverse needs of all citizens where no person is behind. The petitioners alleged that they are facing difficulties in completing the Digital KYC/E-KYC process due to the inability to click “Live Photograph” by Blinking and which prevented them from opening bank account and buying a SIM card from telecom providers.
Permission for its petition, the bench directed the GovT authorities, including the RBI to issue guidelines for adopting alternative mode to verify “livez” or capture the “live photograph” of customers for the purpose of conducting digital KYC to ensure inclusive and user-convenience. It also ordered them to continue with the paper-based KYC process.
“Bridging digital divide is no longer a matter of policy discretion, but has become a constitutional imperative to secure the life of dignity, autonomy and equal participation in public life. The right to digital access, therefore, emerges as an internal component of the right to life and freedom, which needs to be designed incorrectly.
