New Delhi: Justice Yashwant Verma of Allahabad High Court has to face the possibility of impeachment in the upcoming monsoon session of Parliament after being accused in a high-profile corruption case. According to officials cited by the news agency PTI, they remain the only option to avoid the parliamentary proposal to remove the resignation, which if passed, will snatch it from the benefits of pension and retirement.After the fire broke out at his Delhi residence in March, Justice Verma came after an investigation, which discovered several burnt cash sacks in the outhouse. Although he denied the knowledge of money, under the leadership of the in-house panel appointed by a Supreme Court, the then India’s Chief Justice Sanjeev Khanna, he was found guilty after the witness’s statements and Verma’s statement. Based on this report, Justice Khanna urged the President and the Prime Minister to start their expulsion, PTI said.According to Article 217 of the Constitution, a High Court judge can resign by writing to the President. The resignation becomes valid without the need for formal approval. If a judge resigns, they maintain post -retirement rights. However, if removed by Parliament, they lose all such benefits.In Parliament, a proposal for removal should be supported by at least 50 Rajya Sabha or 100 Lok Sabha members. Once recruited, the 1968 Judges (Inquiry) Act compulsory a three -member committee, which includes judges of the Supreme Court, Chief Justice of the High Court and a reputed jurist, who are to investigate the allegations. However, Parliamentary Affairs Minister Kiren Rijiju said that the matter is “a little different” as an in-house committee has already abolished its investigation. “It cannot be brushed on one side,” Rijiju was asked by PTI, saying that the current report with a statutory investigation process would be a case for the speaker or chairman to decide.Vice President Jagdeep Dhikar expressed disappointment over a criminal investigation in the case, meeting members of the Punjab and Haryana High Court Bar Association. “A very painful event occurred … a cash was carried, obviously, unaccounted and illegally tainted,” he said.Dhankhar criticized the internal mechanism of the judiciary to preserve his members from the FIR, saying, “An FIR cannot be registered until the judiciary is allowed by a function at the highest level.”Justice Verma has since been transferred to the Allahabad High Court, where he has not been given any judicial duty. Rijiju has initiated consultation with political parties to create consensus on the proposal, which may be the first impeachment to be taken in the new Parliament House.The monsoon session of Parliament is scheduled from 21 July to 12 August.
