“Keeping in mind the facts and circumstances of the case, and at the same time in mind the nature of the crime, evidence, complexity of the accused and the presentation of the lawyer, I am from the idea that the applicant has made a fit case for bail,” it is said.
Earlier, the accused presented that it was an “recruitment case” by the woman that she was an adult and resided in a PG hostel. She went to a restaurant with her friends, with her own wish, where she consumed alcohol. Because of this, she “got very intoxicated.”
The accused’s lawyer further argued that the woman and her friends stayed at the bar till 3 am. As he needed support, he decided to go to the man’s house for rest.
It is alleged that the accused instead took him to his relative’s flat and raped him twice and against the evidence on the record, the lawyer told the court.
It was also argued that given the facts of the case mentioned by the woman, it is not a case of rape, but it may be a case. Consent relationship between them.
