Kilmar Abrego Garcia: The Federal Judge again orders the Trump administration to wrongly remove the L Salvador

In a rapid rebuke, the American district JJDGE Paula Shinis ruled on Sunday that the government had no legal basis for detaining or deporting Abrego Garcia. Zinis wrote in his order according to the news agency AP, “He had no legal right to arrest him, there was no justification for taking him into custody, and there was no basis to send him to Al Salvador, allowing him to be transported alone in one of the most dangerous jails in the Western Hemisphere.”
Abrego Garcia was first provided with exile by an immigration judge in 2019. Despite this, US immigration and customs enforcement (ICE) deported him that the White House called him “administrative error”. Judge Shinis dismissed the government arguments that the courts lacked the right to intervene. He said, “After accepting the serious error, the defendants now argued that the court lacks the power to listen, and they lack the power to order Abrego Garcia to return,” he said in the ruling.
The Department of Justice, Arase Reuvene, who represented the government in the court, admitted, “We believe that he should not have been removed by Al Salvador” and when asked why Garcia was held, replied, “I don’t know,” according to the AP.
Reveeni has been placed on administrative leave since then.
Attorney General Palm Bondi told Fox News on Sunday, “He is now on administrative leave and we will see what happens,”, while Revveni’s court room said “walking in a defense counsel, while accepting something in a criminal case, walking in a defense counsel.”
The Department of Justice has appealed to the order of Judge Shinis to the 4th US Circuit Court of Appeals, arguing that it is unconstitutional to force the Executive Branch to work on foreign soil.
The Trump administration stated that such an order would force the US government to “force a certain action by a foreign sovereign”, which is called “constitutionally unbearable”.
Meanwhile, Abrego Garcia’s wife, Jennifer Vaske’s Sura, an American citizen, has not spoken to her husband since exile. The BBC reported that his lawyer, Simon Sandoval-Sowanberg, slammed the government’s inaction, “a lot of tweets. The White House press conference was lots. Judge Shinis has ordered that the government “convenient and influence” the return of Ebrego Garcia until Monday night.
